We are Manhead Merchandise, a worldwide leader in the creation, design, and production of merchandise associated with some of the world's most-iconic musical artists and bands.

As part of these services, Manhead operates certain websites, stores, and other services (which we refer to in this privacy policy as "Sites") to help our artists and bands stay connected with their fans.

This privacy policy describes Manhead's data practices, including the collection, processing, use, and sharing of data through the Sites that link to this privacy policy, along with the choices and rights you have to control these data practices.

Our Company

The Sites that link to this privacy policy are operated by Manhead LLC, located at 953 Main Street, Suite 101, Nashville, TN 37206. As used in this policy, "Manhead," "we," "us," and "our" refers to this company, who acts as a data controller and is responsible for the processing of personal data by the Sites pursuant to applicable privacy and data protection laws.

We have produced this privacy notice in order to keep you informed of how we handle your personal data. All handling of your personal data is done in compliance with applicable data protection laws, including the General Data Protection Regulation ((EU) 2016/679) and the UK General Data Protection Regulation ("UK GDPR") (collectively, "GDPR"), and applicable U.S. federal and state privacy laws, including the California Privacy Rights Act ("CPRA").

The terms "Personal Data", "Special Categories of Personal Data", "Personal Data Breach", "Data Protection Officer", "Data Controller", "Data Processor", "Data Subject" and "process" (in the context of usage of Personal Data) shall have the meanings given to them under applicable data protection laws.

We will only use the requested materials for purposes of verifying your identity in order to comply with the Subject Access Request. We do not charge any fee for purposes of complying with a Subject Access Request and our response will be made within thirty (30) days unless our Data Privacy Contact deems your request as being excessive or unfounded. If this is the case, we will inform you of our reasonable administration costs in advance and/or any associated delays, giving you the opportunity to choose whether you would like to pursue your request.   • Direct any service providers to delete your personal information from their records.

Right to Limit Use of Sensitive Personal Information You have the right to direct us to limit our use of your sensitive personal information to only that which is necessary to perform the services or provide the goods reasonably expected by an average consumer. Who is the Data Controller?

We are the Data Controller for personal data collected from customers in the United States. For customers located in the United Kingdom or the European Union, the Data Controller is our UK subsidiary, Manhead UK Ltd., which determines the purposes and means of processing your data.

In certain situations, we may share your data with third parties, such as postal carriers, courier or delivery companies, or payment providers, for the purpose of fulfilling your order. In these cases, these third parties may act as independent Data Controllers for the data they process.

What are the lawful bases for processing personal data?

Under GDPR, there must be a 'lawful basis' for the use of your personal data. What are Manhead 'legitimate interests'?

Legitimate interests are a flexible basis upon which the law permits the processing of an individual's personal data. To determine whether we have a legitimate interest in processing your data, we balance the needs and benefits to us against the risks and benefits for you of us processing your data. This balancing is performed as objectively as possible by individuals within our company who handle matters related to Data Privacy. About our processing of your data

We might collect, process, use, store or otherwise transfer different kinds of Personal Data about you which we have grouped together as follows:

Please be aware that if you provide such information in a public forum, such as a fan community chat room, we may inadvertently process it. We advise you not to share such data in public areas of our services. For purposes of this Privacy Policy, "Special Categories of Data" such as details about race or ethnic origins, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, genetic or biometric data.

We also collect, use and share Aggregated Data such as statistical or demographic data. Aggregated Data can be derived from your Personal Data but is not itself Personal Data as it cannot be used to reveal your identity. If Aggregated Data is ever used in combination with your Personal Data and becomes identifiable, it will be treated in accordance with this notice.

Manhead holds different categories of personal data for different periods of time. Wherever possible, we will endeavor to minimize the amount of personal data that we hold and the length of time for which it is held.

The length of time we retain personal data depends on the purposes for which we collect and use it, and/or as required to comply with applicable laws and to establish, exercise or defend our legal rights. If we process your data on the basis of 'legitimate interests', we will retain your data for as long as the purpose for which it is processed remains active. Text marketing: With your permission, we may send text messages or direct messages about our store, new products, and other updates. Updates include Checkout Reminders. Webhooks or other automated agents and/or programs may be used to trigger the Checkout Reminders messaging system, as well as other text messages or direct messages.

Jelly Roll Privacy Policy

Fans make artist careers possible, and data is how artists understand and interact with fans. This privacy policy describes how Jelly Roll, including managers, partners, and agents working on our behalf, collects, uses, and shares data. It also describes your rights to control data about you. Legally speaking, Jelly Roll is the “controller” of this data and is primarily responsible for how it is collected, used, and shared.

We use Manhead LLC to assist with payment processing, fulfillment, and customer support for our online merch store. Because of the way the banking system works, Manhead LLC acts as a “data controller” for payment processing data and uses that data independently in accordance with their privacy policy, located at https://jellyroll615.com/pages/privacy-policy. For everything else, Manhead LLC acts as a service provider and only uses data about you on our behalf.

The disclosures in this privacy policy cover websites, stores, campaign tools, fan clubs, live events, social media accounts, and similar technologies that are operated by or on behalf of Jelly Roll. We refer to all these together as our “Sites”.

Some third-party platforms or tools we may use or link to from the Sites, such as social media, also collect data for their own purposes. In those cases, the platform’s own privacy policy will apply to the data they collect for their own purposes. Storage and retention of data

Our default rule is that we keep information about you as long as it is needed for the purpose it was collected or for a use disclosed above. We will use reasonable security measures to protect your data.

We may use service providers that store data in different parts of the world, including the United States. We take reasonable steps to ensure our service providers comply with international data transfer requirements, usually through approved data transfer agreements.

Children

Our Sites are not directed to children. If you believe we have collected data about your child, please contact us and we will either delete that data or obtain your parental consent for its use.

  • Non-discrimination for the exercise of your privacy rights.

If Colorado, Connecticut, or Virginia state privacy laws apply and you are a resident of on of those states, you may have the right to opt out from profiling that may produce legal or other significant effects and/or appeal any decisions regarding exercise of your rights.

If the California Consumer Privacy Act applies and you are a California resident, you may have the right to opt out of having your personal information shared with third parties for the third party's direct marketing purposes.

We collect personal information from:

We may require validation of your identity before fulfilling your privacy rights request. Validation will vary depending on the type of request and risk of disclosure to an unauthorized person. Validation steps may include providing a copy of a government-issued identification or similar, logging in with an account, or providing other details that support the authenticity of the request.

You may designate a third party as an agent to make privacy rights requests on your behalf. An agent must be designated in writing or through a power of attorney. We will require a designated agent to validate their authority prior to fulfilling requests made on your behalf.

EEA and UK disclosures

If you are located in the European Economic Area or United Kingdom, you may have additional rights regarding our processing of personal data about you.

You may the right to:

  • Correct inaccuracies or delete personal data about you.
  • Object to or restrict processing of personal data about you.
  • Opt out from direct marketing, profiling, and/or targeted advertising.

If you believe our processing of personal data about you does not comply with applicable laws, you may also have the right to lodge a complaint with your local supervisory authority.

We do not process your personal data for automated decision-making. 

Our processing of your personal data may require transfer of your personal data outside of the European Economic Area and United Kingdom. In these cases we will take steps to apply approved safeguards, usually through approved data transfer agreements.
